MIRAFELD NON‑EXCLUSIVE PERSONAL USAGE LICENCE     

1. Parties and Background

1.1 This Licence is between:

  • MiraFeld , and

  • The individual who purchases a MiraFeld print.

1.2 When you buy a MiraFeld print , you are buying:

  • a physical copy of the artwork; and

  • a non‑exclusive personal usage licence to display that Print, on the terms below.

1.3 This Licence applies only to standard prints sold with a Non‑Exclusive Personal Usage Licence. It does not apply to:

  • original artworks (which usually include an Exclusive Personal Usage Licence); or

  • any Business or Merchandise use, which require separate licence agreements.

2. Nature of the Licence

2.1 Once you have paid in full, the Licensor grants you a non‑exclusive, non‑transferable, non‑sublicensable licence to use the artwork shown in the Print (Artwork) for personal, non‑commercial purposes only.

2.2 Because this Licence is non‑exclusive, the Licensor may sell or license the same Artwork to other people.

2.3 You do not receive ownership of the Artwork or any copyright. All intellectual property rights remain with the Licensor.

3. What You May Do

3.1 You may:

(a) display the Print in your home or other personal space;

(b) give the physical Print to someone else as a personal gift; and

(c) resell the original physical Print as a second‑hand item (for example, selling a framed print you no longer want), as long as you do not make any copies.

3.2 You may share photos of the Print in your space on social media for personal reasons, as long as:(a) the post is not used to promote a business, product, or service; and(b) where reasonable, you credit MiraFeld or tag/link to MiraFeld.

4. What You May Not Do

4.1 You must not:

(a) scan, photograph, or otherwise copy the Artwork in order to sell, distribute, or share it;

(b) print or reproduce the Artwork on products for sale (such as clothing, prints, stationery, packaging, digital products, NFTs, or other merchandise);

(c) use the Artwork as, or as part of, a logo, brand, or other business identity;

(d) upload high‑resolution images of the Artwork to any site or service that lets others download, print, or commercially use it;

(e) claim that you created the Artwork or own the copyright;

(f) create new artworks, designs, or products based on the Artwork for any commercial or public use; or

(g) try to register the Artwork (or any part of it) as a trade mark, design, or other registered right.

5. Term and Termination

5.1 This Licence starts when you complete payment for the Print and continues indefinitely, unless ended under this clause.

5.2 The Licensor may terminate this Licence immediately by written notice if you:

(a) use the Artwork for business or commercial purposes;

(b) reproduce, distribute, or sell copies of the Artwork in breach of this Licence; or

(c) seriously breach this Licence and do not fix the breach after being asked to do so.

5.3 If this Licence is terminated, you must:

(a) stop any use of the Artwork that breaches this Licence; and

(b) not make or keep any copies of the Artwork other than the original physical Print.

6. Intellectual Property and Artist Rights

6.1 All copyright and other intellectual property rights in the Artwork remain with the Licensor.

6.2 You agree not to present the Artwork in a way that suggests you created it or own the copyright.

6.3 The Licensor keeps the right to:

(a) display the Artwork in portfolios, on websites, and on social media; and

(b) reproduce or license the Artwork in other formats or contexts, subject to any other exclusive agreements the Licensor has made.

7. Governing Law and Contact

7.1 This Licence is governed by the laws of New South Wales, Australia. Any disputes will be dealt with in the courts of New South Wales (non‑exclusive jurisdiction).

By purchasing a MiraFeld print, you acknowledge that you have read (or had the chance to read) this Non‑Exclusive Personal Usage Licence and agree to be bound by it.
